Privacy Policy
PicoList is committed to protecting the privacy of its Members who visit and participate in the
services provided by the PicoList.org Website ("the Site"). This Privacy Policy describes
the practices of PicoList in respect to the collection, use, disclosure and storage of information.
CONSENT AND AMENDMENT
Your use of the Site constitutes your consent to the terms and conditions of this Privacy
Policy. If you do not agree to any of the terms and conditions of this Privacy Policy,
your sole remedy is to delete any registration associated with your participation in the
services of the Site and stop using the Site.
PicoList may amend portions of this Privacy Policy at any time without your consent or
authorization. PicoList will notify you of any such changes, additions or deletions
by posting notice of such changes on the Site, and PicoList encourages you to periodically
check the Site to ensure that you are always informed of the then current terms of
this Privacy Policy. Your continued use of the Site or of any services of PicoList
following notice of such changes constitutes your consent to the terms of the
Privacy Policy as amended.
COLLECTION OF INFORMATION FROM PROSPECTIVE MEMBERS
Visitors may register to receive or send information as part of their participation
in PicoList services. Registered visitors are Members of the Site. Members who
register to receive information are referred to as "Subscribers", and Members who
send information are referred to as "Senders". Senders are also Subscribers, but
Subscribers are not Senders and are not authorized to provide Content to PicoList
Subscribers unless they specifically register as Senders in order to do so.
All prospective Subscribers will be required to complete and submit a Subscriber
application form ("Subscriber Application Form") to PicoList. This form
will include the Subscriber's email address and a selected postal code
for the purpose of selecting Content the Subscriber will receive. Subscribers
may also elect to submit other forms ("Subscriber Preference Forms") to
customize PicoList services and provide additional Content selection
criteria.
All prospective Senders will be required to complete and submit a Sender
application form ("Sender Application Form") as well as a Subscriber
Application Form to PicoList. The information which PicoList will collect from each
prospective Member as part of the Sender Application Form will include
will include, without limitation, the following (collectively, "Sender
Personal Information"): name, e-mail address, mailing address, organization
type and affiliation and and some demographic information; and other personal
other personal or business information that PicoList may require.
COLLECTION OF ADDITIONAL INFORMATION
From time to time PicoList may request additional information from Members in connection
with the provision of its services to Members. In addition, Members or other
Users may elect to provide information to PicoList through the Site
or otherwise. Information collected outside of the Subscriber or Sender application
process will constitute "Other Personal Information".
"Subscriber Personal Information", "Sender Personal Information" and "Other Personal Information"
collectively constitutes "Personal Information" and will be governed by the provisions of
this Privacy Policy.
COLLECTION OF TRAFFIC DATA
When you visit any part of the PicoList Site, the Site's systems automatically collect
basic information about your computer provided by your browser, including:
your IP address, operating system, browser software and Internet Service Provider.
This information is used to improve the ability of the Site to provide Member services.
INFORMATION SECURITY
Storage of information:
PicoList employs reasonable security safeguards in order to protect against the
loss, misuse or interception by third parties of information under the control
of PicoList. However, complete confidentiality and security is not yet possible
over the Internet. PicoList assumes no liability for any damages Users may suffer
as a result of interception, alteration or misuse of information (including
Personal Information) transmitted over the Internet.
Passwords:
When you register as a Subscriber you should select a password that is difficult
to guess and never share your PicoList password with anyone. PicoList representatives
will never ask you for your password, so any e-mail or other communication requesting
your password should be treated as unauthorized and suspicious. If you do share your
PicoList password with a third party for any reason, you may be responsible
for actions taken using your password. If you believe someone else has
obtained access to your password, please change it immediately using
facilities available on the PicoList site.
USE OF COOKIES
"Cookies" are small information packets that a website creates which are stored on the hard drive
of a user's computer by the user's browser. PicoList uses cookies to recognize Members
after they have authenticated ("Logged in") throughout the site. Visitors may reject cookies,
sent by PicoList by directing their browsers to do so. Rejecting cookies will limit
the Users' ability to access the services available on the Site.
USE OF INFORMATION
Processing of Application Forms
PicoList uses the Personal Information it collects as part of the Application Form to process
the applications of Members. In addition, PicoList will use Personal Information
as required to provide continued service to its Members. PicoList will also collect and
store Personal Information collected from Members for back-up, archival and other record
keeping purposes.
Aggregation and display of information
PicoList may aggregate Personal Information provided by Members for the purpose
of statistical analysis and quality improvement. This may include
display of Subscriber postal codes on maps or lists. Such displays will never
include any other information associated with individual Subscribers.
Email Notices
Email addresses submitted to PicoList by Members are needed to enable PicoList
services. PicoList also uses Member email and mailing addresses from time
to time to send notices of service or system updates and other advisories.
DELETION OF INFORMATION
If you cancel your PicoList subscription ("Unsubscribe"),
your email address is deleted from the active Subscriber database.
It may be retained in backup copies of the database. You may
may continue to receive PicoList services for a short period
after you Unsubscribe as a result of latency in PicoList
computer systems.
If you have registered as a Sender, your
contact information will be retained and linked to messages you
have sent using PicoList services.
DISCLOSURE OF INFORMATION
Disclosure Required by Law
Circumstances may arise in which PicoList is compelled by law, court order, regulation,
subpoena or other legal compulsion to disclose Personal Information to a third party or
government authority. PicoList will comply with all such legal obligations. In addition,
PicoList may disclose Personal Information if, in the good faith opinion of PicoList,
such disclosure is necessary or appropriate to: (a) conform to or comply with any law,
regulation or court order; (b) protect and defend the rights or property of PicoList
or any of its suppliers or licensors, whether or not required to do so by law; or
(c) protect the personal safety of Users or the public. PicoList also reserves the
right to disclose Personal Information to appropriate authorities at its discretion when
it appears that activities which are illegal or in violation of any terms and conditions
governing its services are taking place.
Disclosure to agents and contractors
Only authorized agents and contractors (who have agreed to keep information
secure and confidential) are allowed to have access to Personal Information
stored in the PicoList database as needed to assist PicoList to provide
services to its Members.
Disclosure of Subscriber Personal Information
PicoList will not disclose Subscriber email addresses to any third party
except for disclosure required by law, disclosure to successor
organizations, and in the case of communication with Senders
explicity initiated by Subscribers by means of forms designed
specifically for this purpose that are made available on the Site.
In case of communication sent by Subscribers to Senders via the
PicoList Site, Subscribers will be advised on any occasion that their email
addresses will be provided to Senders and their consent will specifically be
required in each instance.
Disclosure of Sender Personal Information
Senders assume responsibility for information they send to Subscribers,
and as such Sender Personal Information used for identification and contact,
including Sender name, mailing address, email address and organization affiliation
is considered to be public. PicoList will provide Sender contact information
to its Members. Sender email addresses are included in the 'from' and 'replyto' field
of PicoList message headers to allow Subscribers to respond directly to the Sender.
PicoList also provides a means for Subscribers to send Senders messages to
Sender email addresses through a contact form on the Site. This form will be enabled
for a period of time after the Sender has sent a message to the Subscriber.
PicoList will provide a list of organization affiliations of Senders to
Members or Visitors.
Disclosure to successor organizations
It is possible that PicoList in the future could merge with or be acquired by another
organization. In such an event, the successor organization would have access to the information
maintained by PicoList, but would continue to be bound by this Privacy Policy
unless and until it is amended and published.
